With regard to the protection of your personal data entrusted to us and the fact that on May 25, 2018, the provisions of Regulation (EU) 2016/679 of the European Parliament and of the Council of April 27, 2016, on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC, hereinafter referred to as the GDPR, came into force, we kindly inform you that we have adjusted the processing rules by HERKULES Bogusław Raatz of your personal data to the new regulations, and we assure you that the personal data provided by you are properly secured, and all necessary procedures have been implemented in our company to ensure their proper protection and fulfillment of legal obligations in this regard.

In accordance with Article 13(1)-(2) of the GDPR, we inform you that:

The Controller has appointed a Data Protection Officer, whom you can contact via email: info@herkules-sc.pl or in writing, via traditional mail at: HERKULES Bogusław Raatz, ul. Hodowlana 45/1, 86-005 Białe Błota with the note “Personal Data Protection”.

Personal data will be processed by HERKULES in connection with the business activity, in particular:

  • conclusion of a contract or execution of an order, provision of services, placing orders, requests for quotations, business contacts, etc.,
  • fulfilling the legal obligation incumbent on the Controller, e.g., issuing and storing invoices and accounting documents,
  • for the purpose of securing persons and property within the area administered by HERKULES,
  • for archival (evidentiary) purposes, which are the realization of our legitimate interest in securing information in case of a legal need to prove facts,
  • for the purpose of establishing, investigating, or defending against claims, which is the realization of our legitimate interest,
  • creditworthiness verification.

Personal data may be disclosed to entities providing postal, courier, and transport services to the extent necessary to perform contracts between the Customer and HERKULES, legal or IT services, and, in justified cases, data may be transferred to authorized institutions and supervisory authorities, courts, insurance companies, and healthcare facilities.

Providing personal, address, and telephone data in connection with the conclusion of a contract, services provided on its basis, as well as to respond to inquiries is voluntary. Without providing this data, it is not possible to conclude a contract, provide services, or respond in writing or orally to inquiries.

Personal data will not be transferred outside the European Economic Area or to any international organization.

Personal data will be stored for the duration of cooperation: no longer than 5 years from the last business contact or 1 year after the expiration of any claims arising from concluded contracts, and in relation to accounting documents containing personal data – in accordance with the law in this respect.

Rights of the person whose personal data are concerned:

  • access to their personal data,
  • rectification of their personal data,
  • erasure of their personal data,
  • restriction of processing of their personal data,
  • objecting to further processing of their personal data,
  • right to withdraw consent to the processing of personal data,
  • right to lodge a complaint with the supervisory authority responsible for personal data protection.

Privacy Policy – Cookies

The website does not automatically collect any information except for information contained in cookie files.

Cookie files (so-called “cookies”) are IT data, in particular text files, which are stored on the end device of the Service User and are intended for using the websites of the Service. Cookies usually contain the name of the website they come from, the time of storing them on the end device, and a unique number.

The entity placing cookie files on the end device of the Service User and accessing them is the operator: HERKULES Bogusław Raatz, ul. Hodowlana 45/1, 86-005 Białe Błota.

Cookie files are used for:

  • creating statistics that help to understand how Service Users use websites, which allows improving their structure and content;

  • “necessary” cookies, enabling the use of services available within the Service, e.g., authentication cookies used for services that require authentication within the Service;
  • cookies used to ensure security, e.g., used to detect abuses in terms of authentication within the Service;
  • “performance” cookies, enabling the collection of information on how Service Users use websites;
  • “functional” cookies, enabling “remembering” the settings selected by the User and personalizing the User interface, e.g., in terms of the selected language or region from which the User comes, font size, appearance of the website, etc.;

In many cases, the software used to browse websites (web browser) by default allows storing cookie files on the end device of the Service User. Service Users can change cookie settings at any time. These settings can be changed in particular in such a way as to block the automatic handling of cookie files in the web browser settings or to inform about their every placement on the Service User’s device. The Service Operator informs that restrictions on the use of cookie files may affect some functionalities available on the websites of the Service.

Cookie files placed on the end device of the Service User and used may also be used by advertisers and partners cooperating with the Service Operator.

Information regarding the processing of personal data

The processing of personal data complies with Regulation (EU) 2016/679 of the European Parliament and of the Council of April 27, 2016, on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC, the Act of May 10, 2018, on the protection of personal data (Journal of Laws of May 24, 2018, item 1000), and the Act on the provision of electronic services.
